Scope and Purpose

These Terms of Service govern your use of Kombucha Kenya's website and online store. These terms apply to all users, customers, and visitors of Kombucha Kenya webistes.

Acceptance of Terms

By using our website and making purchases, you agree to these Terms of Service. If you do not agree, please do not use our website.

User Accounts and Responsibility

While using our website, you may establish a user account with us. You must provide accurate information that is asked for. Your account will be password protected, and hence you are responsible for maintaining the security and confidentiality of your user account and for any and all activities that occur on / through your Account.

Therefore, do not disclose or share your password, or related credentials such as One Time Passwrds (OTP) with any party. Kombucha Kenya shall not be liable for the loss or breach of your account the will come from the unauthorized use of your user account.

Nature of our products.

We deal with the manufacture/production of natural probiotic refreshments namely kombucha and Kefir which may be of benefit or aid to the consumer. Our products are not in any way prescription drugs. They are part of the wide scope of healthy foods. Our products promote a healthy lifestyle. Therefore we do not claim to be doctors or treat diseases/illnesses.

Product Information and Pricing

We recommend that you read the product information carefully to choose wisely what suits your purchase,and undertand its storage requirements. Product descriptions and information are subject to change without notice. All products have an availability. You will not be able to purchase a product that has been marked as "Unavailable" or "Discontiued". You will however be able to order a product that has been marked as "Available" or "Next Day Delivery".

We strive for accuracy, but errors in pricing and availability of products may occur. We reserve the right to change prices and products at any time.

Ordering and Payment

On shop.kombuchakenya.co.ke, you can order directly through us or, indirectly through an approved Kombucha Kenya stockist near you. We also serve caterers; we have 10 and 20 litre packaging for caterers. Lastly, for clients who prefer stronger tasting kombucha, we offer strong kombucha available in 1 litre, 10 litre and 20 litre packages. It is important to note that for catering orders and strong kombucha orders, they are on a preorder basis and can take upto 9 days before we dispatch the order.

You can access all your orders that you have placed on our site by clicking on your name on the navigation bar and then clicking on order history, when logged in. Orders can be cancelled anytime before payment of the products. Orders placed with stockists will be auto-deleted if not collected in 30 days.

Payment for orders can be made online through M-pesa or Airtel Money or using credit cards. All payments are processed securely and discreetly. We do not collect or store credit card information. We also accept payments on delivery for Nairobi orders only.

Anonymous Orders

Anonymous orders or Guest orders are orders that are placed without neccesarily having to create an account on our E-commerce website. There is a level of anonymity as we do not hold any personally-identifying information of the user, and the guest orders have a expiration period of 24 hours. While guest orders also have a time convenience in the process of placing an order, Users who place guest orders have a few restrictions as compared to users with an existing account. These restrictions/features include:

1. (i) The user will be unable to choose any other method of payment except M-Pesa.
2. (ii) The user will be unable to use coupons for discounts.
3. (ii) The user will be unable to buy from nearby stockists.
4. (iv) The user will be unable to track/trace his/her previous orders.
5. (v) Anyone can view the user's order details as it is not protected with an account. Therefore, the user is responsible for whom the order details link is shared with.

Guest orders autodelete themselves in 24 hours from our database since the time the guest order was placed, and are not recoverable.

Shipping and Delivery

We do same day deliveries for orders placed before 12 noon. Delivery days are between Mondays and Saturdays. Delivery time may vary depending on your location, however we strive to deliver within 4 hours from the time of purchase. We charge a flat delivery fee of 200/= all over Nairobi county, except within Nairobi CBD where we deliver freely. Nairobi CBD is within the confines of Uhuru Highway, University way, Haile Sellasie Avenue and Kirinyaga road.

For clients residing in a different county, we ship your order via your preferred parcel delivery / courier service. We do not take any responsibility of the damage or loss of products from the shipping options that you choose.

If you need to reschedule your delivery, prior communication is expected. It is treated as damages to Kombucha Kenya when an order is dispatched and delivered more than twice to the location provided and the recepient of the order is unavailable or unreachable to receive the order. These damages can attract damage fees or account suspension or both.

Returns and Refunds

We do not accept any product returns or exchanges from whatsoever situation due to the nature of Kombucha Kenya's products.

Service Fees

There will be a service fee applied when you pay though any of the online payment gateways on our website. This service fee is charged per transaction and is either 0.55% or 3.5% of the value of transaction, depending on which payment gateway you choose. The service fee is charged to facilitate the payment mechanism. Take note that the percentage of the service fee is set to change anytime in the future without notice.

Intellectual Property

This Website contains material which is owned by or licensed to us. You acknowledge and agree that Kombucha Kenya is the exclusive owner of all rights, trade names, copyrights, logos, works in progress or any other form of intellectual property associated with any and all Kombucha Kenya's products including any documentation concerning the use, development, production, sale, marketing or operation of Kombucha Kenya's products. You shall not modify, disassemble, adapt, alter, copy, or create derivative works from any materials associated or included with, or embedded into, any of Kombucha Kenya's products.

Errors, Inaccuracies and Omissions

We cannot guarantee that the use of shop.kombuchakenya.co.ke will be free of inaccuracies or errors. Therefore use with caution at your own risk.

We may correct any errors, inaccuracies, or omissions, and change or update information on our website at any time without prior notice, including after you have placed an order. We are not obligated to honor incorrect or outdated information related to products or services.

Governing Law

This Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Kenya. You acknowledge that you have thoroughly read this Terms of Service, and understand that it is a release of liability. By agreeing, you are waiving any right you might have to bring a legal action or assert a claim against Kombucha Kenya or its respective representatives.
